What penalties will men face for ignoring the summons sent by mail?

In Ukraine, military-registered citizens are already receiving summons by mail. Ignoring such a notification from the TCC and SP is subject to administrative penalties.

Partner at the law firm "Leshchenko, Doroshenko & Partners," Lydia Karpliuk, stated in a comment for "Glavred" that there will be no automatic fines for failing to respond to the summons. However, the act of sending the letter and its return to the TCC will be considered proper notification, regardless of whether the individual received the letter, refused it, or was even unaware of it.

Karpliuk notes that if the citizen fails to appear at the TCC on the specified date, the center will initiate a case of administrative violation. Based on the collected materials, the head of the TCC and SP has the authority to draft a violation report.

What happens next

After the report is approved by the head of the TCC, the individual will receive a notification of the administrative penalty. This should be done within three months of the report's approval, but no later than one year after the violation is identified.

Subsequently, the notification of the fine is sent to the violator's registered address. From the moment of receipt, the individual has 15 days to voluntarily pay the fine.

Citizens can appeal the report in court if they believe that violations occurred during its issuance. In such cases, the decision regarding the necessity to pay the fine is made by the court.

"If the person still does not learn of the report, does not contest it in court, and does not voluntarily pay, and the ruling is transferred for enforcement to the state enforcement authorities, then there an enforcement proceeding is opened and assets are seized and funds are frozen in the debtor's accounts," — emphasized Karpliuk.

We remind you that summons will be sent to the address provided during the last data update. If the military-registered individual has not updated their information, the summons may be sent to a residence found in other state registries.

The summons is considered delivered:

  • on the day the mail is received by the individual, as confirmed by documents from the postal operator;
  • on the day a refusal to receive the mail is marked on the postal item;
  • on the day a note is made indicating the individual is not present at their registered address.

Earlier, "Telegraf" reported what to do if a summons sent by mail is lost. The TCC will consider the letter delivered even if it did not reach the addressee.
