Recently, special prosecutor Jack Smith requested to drop all charges against the newly elected president concerning the case of storing classified documents at his Mar-a-Lago residence in Florida and attempts to influence the 2020 election results, which led to the Capitol riot.

He explained that the Department of Justice must adhere to its policy, which states that a sitting president cannot be indicted for a crime. Therefore, the cases should be closed before Trump returns to office.

Hill reports that the 11th U.S. Circuit Court of Appeals has yet to approve the closure of the case regarding the storage of classified documents, but it is expected to do so soon.

The Capitol Riot

On January 6, 2021, hundreds of Donald Trump supporters breached the police barrier and entered the Capitol building in Washington, where the American parliament was set to certify the results of the U.S. presidential election. The Senate session (and later the House of Representatives) was temporarily interrupted, and a lockdown was declared in Congress. However, the lawmakers later reconvened and declared Joe Biden the winner of the election.

It is known that as a result of the riot, five people died, including four protesters and one police officer, with injuries reported among both protesters and law enforcement.

The events of January 6 led to Trump's impeachment. The House of Representatives charged the then-president with "incitement of insurrection," and on January 13, voted on this article of impeachment. Trump became the only U.S. president to be impeached twice. At the same time, the Senate did not find enough votes to convict Trump.

By July 2024, the U.S. Supreme Court ruled that Trump could seek immunity from criminal prosecution related to the Capitol riot.
