Will "limited-fit" individuals who haven't passed the military medical commission be penalized?

"Men classified as "fit for limited service" must undergo a military medical commission (MMC) by February 5. However, it is still unclear in Ukraine whether they are actually required to go through the MMC or if it is merely a recommendation.

Maria Zvyagintseva, a lawyer from the public organization "Legal Hundred," explained this during a broadcast on Ukrainian Radio.

"Previously, there was no clarity in this regulation since the term 'are subject to' was used instead of 'are obligated to.' At the same time, there was no other mechanism to undergo the MMC than to receive a summons and go through it. Only recently, the Cabinet of Ministers adopted Resolution No. 91 dated January 28, which amended the medical examination process, allowing individuals to seek a referral for the MMC voluntarily, particularly through 'Reserve+'.", she clarified.

The lawyer also emphasized that to avoid misunderstandings and potential consequences, it is better to undergo the examination. Moreover, according to her, a bill No. 12457 has already been registered in the Verkhovna Rada, which aims to clearly define the obligation of "fit for limited service" individuals to undergo the MMC again and extend the deadlines for fulfilling this obligation.

Zvyagintseva commented on the possible penalties if a person fails to undergo the MMC within the specified time frame. She noted that the responsibility depends on whether a violation of military registration rules is recorded.

"On the street, they cannot hold you administratively accountable. Whether there will be a fine or not depends on the wording. If bill 12457 is passed, according to the legislation, laws that alter and mitigate responsibility have retroactive effect. This means, for example, that a 'fit for limited service' person under 25 years old will not have this obligation to undergo the MMC. According to military registration rules, such a person has not violated any rules, and no sanctions will be applied to them. If this bill is not passed or the person is over 25 years old, the obligation to undergo the MMC by certain deadlines remains. If they do not fulfill it, then we can talk about responsibility and the application of sanctions," the lawyer added.

We remind you that the Office of the President proposed to extend the deadline for undergoing the MMC for "fit for limited service" from February 5 to June 5. The corresponding bill has already been registered in the Verkhovna Rada.

It has also been decided that repeating the MMC will be optional for individuals under 25 years old and those officially recognized as persons with disabilities.

Until the law is passed, fines will not be imposed, according to the OП. Territorial recruitment centers will not sanction those who do not manage to undergo the MMC by February 5, and they will not declare such individuals wanted. A corresponding directive will be sent to all units.
