In Ukraine, critical enterprises can reserve their employees. Agricultural workers also have the right to reservation.
Employees of agricultural enterprises can be reserved as well, but there are specific conditions that must be met. This was explained by lawyer Dmitry Franchuk to "RBK-Ukraine".
According to the law "On Mobilization Preparation and Mobilization", the workers can be reserved by those enterprises, institutions, or organizations that ensure the functioning of the agro-industrial complex during the sowing or harvesting period.
According to him, enterprises must belong to the list of those critical for the economy and food security of the country, and then submit the necessary documents to the Ministry of Agrarian Policy of Ukraine, which coordinates the lists with the General Staff of the Armed Forces of Ukraine.
There is also an option for temporary reservation during the sowing or harvesting periods. In this case, a man needs to submit documents to the TCC confirming his employment in agricultural work — a certificate from the enterprise, an employment contract, documents for the farm.
Agricultural workers operating as individual entrepreneurs or founders of farms are also counting on reservation, but only if they can prove that their activities are critical for the region.
"This may include documents about the amount of land being cultivated, the presence of hired workers, production volumes of agricultural products, etc.", he explained.
The lawyer also recommends contacting the Ministry of Agrarian Policy and the regional military administration in advance to include the enterprise in the list of critical ones. In case mobilization has already occurred, this decision can be appealed in court.
